Reader’s Question:

Can you please explain to me: I thought motor vehicle insurance follows the vehicle. Why do you need to purchase SR22 if you no longer own your car?

Maria

Des Moines, IA

Not all auto insurance follows the vehicle.

Liability coverage doesn’t always follow the vehicle, but rather the driver. It can be very complicated to determine which policy should be used primary, secondary or even tertiary in these kind of situations. An SR22 is a certificate which must be filed by the insurance carrier stating that auto liability insurance is in effect for a particular motorist. It is required typically when insurance is given to a person who was in an accident or was convicted of a traffic violation and was unable to show financial responsibility.

Liability insurance is required to pay for property or bodily injury damages to others. Liability can be caused by an person while they are in a motor vehicle or in ANY automobile.

Non Owners Car Insurance

Reader’s Question:

If I don’t have auto insurance at this time because I do not own a vehicle, when I purchase a vehicle can I get insurance in Florida?

Henry

Jacksonville, Florida (FL)

Yes, if you have a valid driver’s license you should be able to buy insurance for a vehicle when you do purchase a new or used car.

If you would like to begin an insurance policy before owning a vehicle, to get a car insurance history started for yourself and cover you when operating other people’s vehicles until you get your own, then you can obtain a non-owner’s policy now. There is no reason to buy a non-owners policy unless you have a specific need to be covered when you don’t own a vehicle. Typically, the reason for this is because you need to satisfy state requirements or you borrow and/or rent other cars often.

Non-owners insurance is coverage to provide a motorist liability protection for when they are at fault in an accident but do not own a car. Non-owners policies can typically include liability, uninsured/underinsured motorist coverages and medical payments,.

Reader’s Question:

What is the difference of sr50 and sr22?

Henry

Thank you for asking Henry.

According to the Indiana Bureau of Motor Vehicles (BMV) an SR-50 is a form used by an individual to show proof of current insurance to the Bureau. The sr50 shows the Bureau the beginning and end dates of the current insurance policy.

Basically, SR 50 is a form required by Indiana (and possibly a few other states) to show proof that a person currently has insurance on their motor vehicle.

An SR 22 is a proof of financial responsibility. In Indiana an SR-22 is required three (3) year period if you are mandated to carry and maintain this financial responsibility certificate. An SR 50 is proof of current financial responsibility that your insurance company would send to the state.

Reader’s Question:

Does an sr22 covers the owner of the car in terms of liability insurance?

Jim

Thank you for asking Jim.

SR-22 is a form which must be filed with the Department of Motor Vehicles by the insurance provider showing that car liability insurance is active for a certain individual. SR-22s guidelines varies from different state and the requirements in one state may be different or will not be applicable in another state. An SR-22 is not intended to be used by a vehicle owner to get liability coverage, other than that which is required on the car.

The SR-22 is not a type of insurance, rather it is proof that you or someone has certain types of insurance that is based upon the financial responsibility laws of your state.

SR-22 car insurance itself is not necessarily anything special in the way that the insurance policy covers the car. The filing of the form for this insurance policy however is required or mandated to by the court or DMV, and what sets it apart from regular insurance policies.

It depends upon your state’s SR-22 requirements on what insurance will be mandated this way.It will be normally at least the state required liability coverages. If this is the case then the vehicle owner will be covered in the same way which regular liability coverages cover them.

Reader’s Question:

How long do you have to carry an sr22 in the state of Iowa?

Carrie

Thank you for asking Carrie.

The Iowa Department of Transportation states that future proof of financial responsibility is required from the first day of your suspension for a conviction, unsatisfied judgment, or violation of the OWI law, and lasts for 2 years. If you fail to show proof or maintain future proof your license and registration may be suspended.

To file future proof of financial responsibility you will have to have your Iowa Authorized insurance company file Form SR-22 (Certificate of Automobile Liability Insurance) with the Office of Driver Services.

In addition to that you will also have to show future proof after a suspension of your license for convictions or for driving while intoxicated. sr22 is required from the first day of your revocation or suspension and lasts two years.

If you are required by the state of Iowa to file a SR-22 you must check with the Department of Transportation to make sure how long your case requires you to carry this certificate of financial responsibility.

Reader’s Question:

Does the recipient of the sr22 needs to sign any document before it becomes in effect?

Naomi

Thank you for asking Naomi.

A recipient does not have to sign the SR-22 form because it is signed by the licensed agent or designated company agent.

The insurance company keeps the form, or in the electronic file, in their database. Each state has different rules and guidelines for how the carrier notifies the state. Typically it is a nightly upload to the Department of Motor Vehicle.

The name of the insured has to sign the insurance application or policy agreement to make the insurance policy effective for an SR-22.

Reader’s Question:

I live in TN and I just want to know how long do I have to carry an sr22?

Hannah

Thank you for asking Hannah.

A SR-22 form is proof of future financial responsibility that is mandated and required under Tennessee Code Annotated 55-12-114. According to the DMV if you are required to file a SR-22 then you should contact your liability insurance company and advise them of the needed filing with the state.

According to the TN DPS an SR-22 can be required for a total of 5 years from your date of suspension or conviction. If the SR-22 is filed for a total of 3 years (36 months) within the 5-year period, the SR-22 may be terminated or removed provided it is not mandated on any other suspension. If 5 years pass from the date of suspension or revocation before you reinstate your driver’s license, then the SR-22 would not be required. If the SR-22 is cancelled, terminated or lapsed before the required period and a new form not filed, your driving privileges will be suspended.

To get more information regarding the specific of your SR22 filing you may contact the Tennessee DPS and get information on how long you will need to carry the SR-22 form with your insurance policy.

Reader’s Question:

What is the difference between the SR-22 and the regular car insurance policy?

Mara

Thank you for asking Mara.

SR22 auto insurance itself is not necessarily anything special in the way that the insurance policy covers the car. The difference of the filing of the certificate for this insurance policy from an average auto owner buys is that of it being required or mandated to by the court or DMV insurance.

Some states consider the SR22 auto insurance as more than just a normal insurance. For example in Florida the SR22 auto insurance may include the bodily injury liability insurance in addition to the PIP and PD coverages which are the state minimum required insurance types. .

The SR22 form must be filed by an insurance provider to the state stating that the required car insurance is in effect and active on file. Typically, this specific car insurance is mandated for a certain period of time and if the individual cancels or terminates the insurance policy the state is notified and penalties are placed on the individual, likely a license revocation or suspension.
